Employment screening law: Giving Employment References in
Arkansas
Arkansas law provides some protection to employers.
On receipt of written consent from a current or former employee, an
employer may disclose to a prospective employer the following
information: date and duration of employment; current pay rate and wage
history; job description and duties; last written performance evaluation
prepared prior to the date of request; threats of violence, harassing
acts, or threatening behavior related to the workplace; nature of and
reasons for separation from employment; and whether the employee is
eligible for rehire. The employer is presumed to have acted in good
faith and is immune from liability for the disclosure and any resultant
consequences unless it is shown that the information disclosed was false
and the employer had knowledge of the falsity or acted with malice or
reckless disregard. (See Ark. Code Ann. §11-3-204.)
Arkansas employment screening: At Will Employment Law
Like many states Arkansas has an at will doctrine. However, Arkansas modified
the employment-at-will doctrine to provide that where an at-will employee relies
on a personnel manual or employment agreement that expressly states that he or
she cannot be discharged except for cause, the employee may not be arbitrarily
discharged in violation of such a provision.
Please note that Federal
employment screening law mandates background checks for employees who are engaged in particular
industries. The Office of Inspector General of the Department of Health and
Human Services maintains a list of individuals who are excluded from
participation in any of its federally-funded healthcare programs. Exclusions are
due to convictions for program-related fraud and patient abuse, licensing board
actions and default on health education assistance loans. Therefore, employers
in affected industries should check the
OIG Exclusion list
before hiring employees who might work in such programs. The FACIS program is
also very important when screening medical personnel.
