Hawaii employment screening law: Giving Employment References in
Hawaii
Hawaiian Employment law provides some protection to employers in Hawaii.
The
Employer is entitled to immunity if acting in good faith as long as the
information provided was not knowingly false or misleading. (HAW stat.
§663-1-95)
Hawaii employment screening law:
Employers are prohibited from considering misdemeanor convictions when a jail
sentence cannot be imposed. (This can also affect some felony records, as well.)
Hawaii employment screening law:
Hawaii has the nation’s most restrictive law on the use of arrest and
conviction records in the employment process. Hawaii Revised Statute 378-2
completely bars most Hawaiian employers from using either arrest or
conviction information in the employment arena. (There are limited
exceptions which apply to the state, counties, private schools, the
Department of Education, financial institutions, the board of an
association of apartment owners, and the manager of a condominium.)
This statute may not preclude an employer from
another state from checking the Hawaiian criminal history of an applicant
who formerly lived in Hawaii.
We have not been able to
determine if this far reaching statute has
not been challenged or interpreted in the courts.

Please note that Federal
employment screening law mandates background checks for employees who are engaged in particular
industries. The Office of Inspector General of the Department of Health and
Human Services maintains a list of individuals who are excluded from
participation in any of its federally-funded healthcare programs. Exclusions are
due to convictions for program-related fraud and patient abuse, licensing board
actions and default on health education assistance loans. Therefore, employers
in affected industries should check the
OIG Exclusion list
before hiring employees who might work in such programs. The FACIS program is
also very important when screening medical personnel.
