the majority of states, employees not working under an employment
contract are deemed to be "at will." At-will employees may be
terminated for any reason, so long as it's not illegal. There are
numerous illegal reasons for termination. Typically such reasons fall
into one of two large categories: illegal discrimination or illegal
termination in violation of a public policy. Generally, employees who
work under an employment contract can only be terminated for reasons
specified in the contract.

The employer is immune from civil liability for providing work-related
information about a current or former employee to a prospective employer
on request by a person who is believed in good faith to be a
representative of the prospective employer or on request or
authorization of the current or former employee. Unless such
work-related information provided by an employer violates the civil
rights of the current or former employee, is knowingly provided to a
person with no legitimate interest in the information, is not relevant
to the inquiry, or is provided with malice or no good-faith belief that
the information is true. (Iowa Code §91B.2.)
Please note that Federal
employment screening law mandates background checks for employees who are engaged in particular
industries. The Office of Inspector General of the Department of Health and
Human Services maintains a list of individuals who are excluded from
participation in any of its federally-funded healthcare programs. Exclusions are
due to convictions for program-related fraud and patient abuse, licensing board
actions and default on health education assistance loans. Therefore, employers
in affected industries should check the
OIG Exclusion list
before hiring employees who might work in such programs. The FACIS program is
also very important when screening medical personnel.
