Kansas employment screening law: Giving Employment References in Kansas
Kansas employment screening law: Kansas employment Law Addresses this issue as described
below:
It provides that an employer is immune from civil liability for disclosure of information
about a current or former employee to a prospective employer. An
employer enjoys immunity for disclosure of date of employment, pay
level, job description and duties, and wage history information. Any
employer responding to a written request from a prospective employer
also enjoys absolute immunity for the disclosure of written employee
evaluations conducted prior to separation and the reasons for separation
and whether separation was voluntary or involuntary. (Kan. Stat. Ann.
§44-119a.)
Kansas employment screening law: Kansas Reporting Limitations (Enacted January 1,
1974)
Kansas employment law also provides the following protection to
employment applicants: Denying employment
Kansas law provides that for an employer to refuse to hire an
applicant, his or her criminal history must
reasonably bear
on his or her trustworthiness or the safety or well
being of the employer’s employees or customers.20
The statute applies to both public and private
employers. In addition, the statute limits liability for employers regarding the
employment decision, as long as the applicable standard is followed.
KS 50-704 No CRA may report records of arrest, indictment,
or conviction of crime, which from date of disposition, release, or parole,
antedate the report by more than seven years.
Exception: If salary will be equal to $20,000 or more, the 7-year restriction
does not apply.

Please note that Federal
employment screening law mandates background checks for employees who are engaged in particular
industries. The Office of Inspector General of the Department of Health and
Human Services maintains a list of individuals who are excluded from
participation in any of its federally-funded healthcare programs. Exclusions are
due to convictions for program-related fraud and patient abuse, licensing board
actions and default on health education assistance loans. Therefore, employers
in affected industries should check the
OIG Exclusion list
before hiring employees who might work in such programs. The FACIS program is
also very important when screening medical personnel.
