Employer can provide fair and unbiased information about an employee or former employee’s gob performance at the request of the employee or prospective employer if they are acting in good faith. So long as the employer does not provide knowingly false, deliberately misleading information nor provide it for malicious purpose, then the employer providing the reference is immune from civil liability for the disclosure. (RI §28-6, 4-1)

Rhode Island employment screening law: At Will law in Rhode Island

In Rhode Island as in most states, employees not working under an employment contract are deemed to be "at will." In Rhode Island, at-will employees may be terminated for any reason, so long as it's not illegal. There are numerous illegal reasons for termination. Typically such reasons fall into one of two large categories: illegal discrimination or illegal termination in violation of a public policy. Generally, employees who work under an employment contract can only be terminated for reasons specified in the contract.

Please note that Federal law mandates background checks for employees who are engaged in particular industries. The Office of Inspector General of the Department of Health and Human Services maintains a list of individuals who are excluded from participation in any of its federally-funded healthcare programs. Exclusions are due to convictions for program-related fraud and patient abuse, licensing board actions and default on health education assistance loans. Therefore, employers in affected industries should check the OIG Exclusion list before hiring employees who might work in such programs.
