Carolina
The state of South Carolina has sought to provide protection
to employers giving references on previous employees.
Section 41-1-65 of the South Carolina Code of Laws addresses
this situation and provides, in part: Unless otherwise provided by law, an
employer who responds in writing to a written request concerning a current
employee or former employee from a prospective employer of that employee shall
be immune from civil liability for disclosure of the following information to
which an employee or former employee may have access: (1) written employee
evaluations; (2) official personnel notices that formally record the reasons for
separation; (3) whether the employee was voluntarily or involuntarily released
from service and the reason for the separation; and (4) information about job
performance. (D) This protection and immunity shall not apply where an employer
knowingly or recklessly releases or discloses false information.

screening law: At Will employment Law-South Carolina
In the Palmetto state, as in most states, employees not
working under an employment contract are deemed to be "at will."
At-will employees may be terminated for any reason, so long as it's
not illegal. There are numerous illegal reasons for termination.
Typically such reasons fall into one of two large categories: illegal
discrimination or illegal termination in violation of a public policy.
Generally, employees who work under an employment contract can only be
terminated for reasons specified in the contract.
Please note that Federal
law mandates background checks for employees who are engaged in particular
industries. The Office of Inspector General of the Department of Health and
Human Services maintains a list of individuals who are excluded from
participation in any of its federally-funded healthcare programs. Exclusions are
due to convictions for program-related fraud and patient abuse, licensing board
actions and default on health education assistance loans. Therefore, employers
in affected industries should check the
OIG Exclusion list
before hiring employees who might work in such programs. The FACIS program is
also very important when screening medical personnel.
